Comunicado del Relator Especial sobre Pueblos Indígenas acerca del Perú

El Relator Especial sobre la situación de los derechos humanos y libertades fundamentales de los indígenas, James Anaya, acaba de haber público un comunicado sobre la preocupante coyuntura peruana manifestando su disposinilidad para contribuir a su abordaje y resolucióm. Relator Especial sobre pueblos indígenas urge al Gobierno de Perú a dialogar con los pueblos indígenas del Amazonas.

El Relator Especial de las Naciones Unidas sobre la situación de los derechos humanos y las libertades fundamentales de los pueblos indígenas, Profesor James Anaya, expresa su más profunda preocupación por los enfrentamientos del viernes 5 de junio, y los eventos subsecuentes, en Bagua, Departamento de Amazonas, Perú, que han resultado en la muerte de aproximadamente 30 personas, incluidas personas indígenas y miembros de la Fuerza Pública, así como decenas de heridos y desaparecidos. El Relator Especial expresa su solidaridad con las víctimas y sus familias.





“Hago un llamado urgente a todos los actores involucrados a que eviten otros acontecimientos de violencia, y exhorto a las autoridades del Estado a implementar todas las medidas ya establecidas, así como a adoptar todas las medidas adicionales necesarias, de acuerdo con los principios internacionales de derechos humanos, para proteger los derechos humanos y las libertades fundamentales de las personas afectadas”, dijo James Anaya. Además, el Relator Especial insta al Estado a investigar seriamente todos aquellos actos relacionados a esta situación que puedan indicar violaciones a los derechos humanos y llevar a la justicia a los responsables, así como a asegurar la no repetición de hechos similares. Asimismo, el Relator Especial insta a las personas y pueblos indígenas involucrados que sus reclamos y manifestaciones siempre sean de forma pacífica, respectando los derechos humanos de otros.

El Relator Especial también exhorta a todos los actores involucrados a buscar consensos y encaminarse a una vía de dialogo y de entendimiento sobre la base de la tolerancia y respeto a los derechos humanos. “Enfatizo la necesidad de que el Gobierno y los grupos indígenas interesadas hagan un nuevo esfuerzo conjunto hacia una resolución a los conflictos en la región de manera abierta y transparente que facilite el diálogo, evite la violencia y respete los derechos humanos”.

El Relator Especial expresa su disponibilidad de realizar una visita al país para revisar la situación y contribuir a la búsqueda de tal resolución a los conflictos, dentro del ámbito del mandato atribuido por el Consejo de Derechos Humanos de Naciones Unidas, para promover el respeto a los derechos humanos de los pueblos indígenas.

Finalmente, el Relator Especial desea adherirse a los comunicados previos sobre este tema emitidos por la Oficina Regional para América Latina del Alto Comisionado de las Naciones Unidas para los Derechos Humanos y por la Defensoría del Pueblo del Perú.

El 26 de marzo de 2008, el Consejo de Derechos Humanos nombró al Profesor James Anaya como Relator Especial sobre la situación de derechos humanos y las libertades fundamentales de los indígenas por un período inicial de tres años. El Sr. Anaya es James J. Lenoir Professor of Human Rights Law and Policy en la Facultad de Derecho de la Universidad de Arizona, en los Estados Unidos de América.

Special Rapporteur on indigenous people urges Government of Peru to dialogue with indigenous peoples of the Amazon

The United Nations Special Rapporteur on the situation of human rights and fundamental freedoms of indigenous people, Professor James Anaya, expresses his profound concern over the confrontations that took place on Friday, June 5, in Bagua, Department of Amazonas, Peru, and subsequent occurrences, which have resulted in the deaths of an estimated 30 people, including indigenous individuals and members of the Armed Forces, and in dozens of wounded and missing. The Special Rapporteur expresses his sincere condolences for the victims and their families.

“I urgently appeal to all concerned to avoid further violence and urge State authorities to implement measures already in place, as well as adopt all additional measures necessary, in accordance with international human rights norms, to protect the human rights and fundamental freedoms of the affected indigenous peoples,” said James Anaya. In addition, the Special Rapporteur calls upon the State to seriously investigate all actions that could indicate human rights violations and bring those responsible to justice, as well as to ensure the non-repetition of similar acts. Likewise, the Special Rapporteur stresses to the indigenous individuals and peoples involved that their claims and protests should always be carried out in a peaceful manner and with respect for the human rights of others.

The Special Rapporteur also calls upon all of those involved to explore ways to reach an agreement based on dialogue, mutual understanding, tolerance and respect for human rights. “I emphasize the need for the Government and affected indigenous peoples to make renewed concerted efforts toward a resolution to the conflicts in the region in an open and transparent manner that facilitates dialogue, avoids violence, and respects human rights”.

The Special Rapporteur expresses his willingness to visit the country to review the situation and contribute to the search for such a solution to the conflicts in the region, within the terms of his mandate by the United Nations Human Rights Council, to promote respect for the human rights of indigenous peoples.

Finally, the Special Rapporteur would like to express his concurrence with the previous statements on this issue made by the Latin American Regional Office of the United Nations Office of the High Commissioner for Human Rights and by the Public Defender of Peru.


On 26 March 2008, the Human Rights Council appointed Professor S. James Anaya (United States of America), for an initial period of three years. Professor Anaya is the James J. Lenoir Professor of Human Rights Law and Policy at the University of Arizona (United States).
